General Terms and Conditions Andrew Miller Photography
(updated 22nd April 2026)
Introduction
The contract is in force from when you pay your booking fee with the intention of paying Andrew Miller Photography for photographing your wedding on your chosen date. You are required to return the contract date with both partners' signatures.
Failure to return the signed contract does not, however, invalidate the contract nor absolve you from the acceptance of the Terms & Conditions laid out in it.
Once the booking fee is paid, it is assumed that the contract's Terms and Conditions have been fully agreed to.
WEDDING PHOTOGRAPHY SERVICES AGREEMENT
(England & Wales)
This Agreement is made between:
(1) Andrew Miller trading as Andrew Miller Photography (“the Photographer”)
Address: Bramble Cottage, Llanvair Discoed, Chepstow, NP16 6LY
and
(2) ______________________________________________________________ (“Client 1”)
and
(3) ______________________________________________________________ (“Client 2”)
together referred to as “the Client(s)”.
WHAT THIS MEANS
This sets out who I am and who you are.
- DEFINITIONS
1.1 “Wedding Date” means the date stated in the Contract Summary.
1.2 “Services” means the wedding photography services and any products supplied under this Agreement.
1.3 “Booking Fee” means the non-refundable fee stated in the Contract Summary, subject to the Client’s statutory 14-day cancellation rights under clause 7.3.
1.4 “Balance” means the remaining amount due for the selected package after the Booking Fee is deducted.
1.5 “Working Day” means Monday to Friday, excluding public holidays in England and Wales.
WHAT THIS MEANS
Setting out the definitions of the words to avoid confusion. I know; it seems silly...but thems the rules.
- THE AGREEMENT
2.1 The Photographer agrees to provide the Services to the Client(s) on the Wedding Date.
2.2 The Photographer is hired solely to provide wedding photography services. The Photographer will be helpful where reasonably possible but accepts no responsibility for duties outside the scope of the Services.
WHAT THIS MEANS
What I am paid to do is photography. Everything else is me just being helpful as a decent emotionally intelligent human being.
- WEDDING DATE CHANGES
3.1 The Photographer will photograph the Client’s wedding on the Wedding Date.
3.2 If the Client requests a date change, the Photographer will make reasonable efforts to accommodate the change, subject to availability.
3.3 If the Photographer is unavailable on the requested new date, the booking shall remain for the original Wedding Date unless the Client cancels, in which case clause 12 will apply.
WHAT THIS MEANS
Yes, you can change the date of your wedding. You need to tell me, and I need to be available for the new date. If I'm not available, it's essentially you cancelling the contract, and thus booking fees/deposits etc are non-refundable.
- COPYRIGHT AND LICENCE
4.1 Copyright in all photographs and images remains with the Photographer under the Copyright, Designs and Patents Act 1988.
4.2 The Photographer grants the Client(s) a non-exclusive licence to use, copy and print the delivered edited images for personal, non-commercial use only (“Licence to Print”).
4.3 The Client(s) may not sell, license, or supply images (or derived products) for commercial use to any third party without the Photographer’s prior written permission.
4.4 Wedding suppliers and vendors must request permission before using images for marketing purposes. The Photographer is usually happy to supply images to vendors upon request.
WHAT THIS MEANS
I own the photographs, not you. You have a license to use the photographs for personal use only. You are NOT to share the images with any supplier without my permission. You are not to sell the images to other companies, such as the venue or Stock Photography sites. This is basic UK Copyright Law.
- MARKETING AND DISPLAY USE
5.1 Unless the Client opts out in writing before the Wedding Date, the Client(s) grant the Photographer permission to use images for portfolio, website, social media, sample albums, brochures, venue/vendor samples, advertising, and other promotional purposes.
5.2 The Photographer agrees not to use images unlawfully or in a manner that would reasonably be considered defamatory or damaging.
WHAT THIS MEANS
I can use the images for my marketing. If you would prefer that I NOT do that, YOU must tell me in WRITING. I get it; there may be safeguarding issues, there may be security issues. But unless I'm made aware, I don't mind-read.
- ARTISTIC STYLE AND COVERAGE
6.1 The Photographer retains artistic control over style, editing, poses, locations, and the number of images delivered.
6.2 The Photographer will make reasonable efforts to capture key moments, but due to the nature of live events, some moments may not be captured.
6.3 The Client(s) accept that the Photographer is not liable for photographs not taken or not delivered where they do not meet the Photographer’s professional quality standards.
6.4 The Photographer may be restricted by officiants, venues, or church officials. Restrictions may include movement, positioning, use of flash, and photography prohibitions.
6.5 The Client(s) agrees to cooperate with the Photographer and ensure that sufficient time is allocated for photography throughout the wedding day.
6.6 The Photographer is not responsible for missed photographs due to lateness, changes to the agreed schedule, venue restrictions, or the unavailability of individuals required for specific photographs.
6.7 The Client(s) are responsible for ensuring that key participants are available at the agreed times for photographs.
6.8 Colour and print reproduction may vary due to lighting conditions, digital sensors, print processes, and monitor calibration.
6.9 The Client acknowledges that they have reviewed the Photographer’s portfolio and are familiar with the Photographer’s style of photography and editing.
6.10 The Client agrees that the photographs delivered will reflect the Photographer’s artistic style, which may vary from wedding to wedding depending on lighting, weather conditions, locations, and other circumstances beyond the Photographer’s control.
6.11 Dissatisfaction with the Photographer’s artistic style or editing approach shall not constitute a valid reason for cancellation, refund, or refusal to pay any outstanding balance.
WHAT THIS MEANS
This section basically says the photographer controls how the photos are taken and edited, and while they’ll do their best to capture everything, they can’t guarantee every moment will be captured. Some things may be out of my control, like venue rules, timing issues, or people not being available, and they’re not responsible if that affects the photos.
You agree to work with them, make sure people are ready when needed, and accept their style based on their previous work. You also can’t ask for a refund or refuse to pay just because you don’t like the final style or editing.
- BOOKINGS, FEES AND PAYMENT TERMS
7.1 An agreed Contract Summary and payment of the Booking Fee confirms the booking.
7.1.1 You can agree to the Contract Summary via email. There is no legal requirement to print, sign and post the contract back to the Photographer
7.2 The Booking Fee forms part of the total package price and is deducted when calculating the Balance.
7.3 The Client has the right to cancel within 14 days of paying the Booking Fee (cooling-off period). If cancellation is made within this period, all monies paid will be refunded and the Agreement will be terminated.
7.4 After the cooling-off period, the Booking Fee becomes non-refundable.
7.5 The Booking Fee must be paid within seven (7) Working Days of booking. One reminder will be issued. If payment is not received, the Photographer may cancel the provisional reservation without further notice.
7.6 Final invoices will normally be issued approximately six (6) weeks before the Wedding Date.
7.7 The Balance must be paid in full no later than four (4) weeks before the Wedding Date, unless a deferred payment plan has been agreed in writing.
7.7.1 A deferred payment option must be requested no less than 4 months from the date of the wedding.
7.8 Failure to pay the Balance by the four (4) week deadline will be deemed a material breach of contract. The Photographer may treat the booking as cancelled by the Client(s) due to non-payment and will have no obligation to attend or provide Services.
7.9 All additional goods and services (including albums, prints, special editing, additional digital products, gallery extensions, and any extras not included) must be paid for in full before ordering.
7.10 Title to all goods remains with the Photographer until paid in full.
7.11 If any additional invoices apply (including meal reimbursement under clause 17), these must be paid before gallery access or product delivery is provided.
7.12 A deferred payment option may be available by written agreement. Under this option the Client may defer payment of the Balance up to a maximum of three (3) months after the Wedding Date, subject to conditions set by the Photographer.
7.13 Late Payment Charges: If any amount is unpaid after the invoice due date, the Photographer may charge a one-off administration fee of £25 plus simple interest (not compounded) at a rate of 3% per annum above the prevailing Bank of England base rate, calculated daily until payment is received in full. This reflects administration time and financial impact.
7.13.1 The Photographer use the following website to enable the Bank of England base rate to be set - https://www.bankofengland.co.uk/monetary-policy/the-interest-rate-bank-rate
7.14 A payment plan may be requested by the Client to spread the cost the of the wedding photography.
7.14.1 A payment plan would be the balance – booking fee / number of months until the wedding.
7.14.2 Working example:
- Total Collection Price - £1300
- Booking Fee - £300
- Balance - £1000
- 18 months to wedding date
- =£1,000 / 18
- 17 monthly payments at £55.56
- Final Payment of £55.48
7.15 A 5% discount is applicable if the full balance owing is paid within thirty (30) days of booking.
7.15.1 The 5% discount is applicable to the full balance
7.16 The Photographer may withhold delivery of photographs, galleries, albums, prints, or any other products until all outstanding invoices are paid.
7.17 The Booking Fee secures the Photographer’s availability for the agreed Wedding Date and compensates the Photographer for reserving that date and declining other potential bookings. The reserved date is placed onto the Photographers online publicly visible calendar.
7.18 Because the Photographer can only accept a limited number of weddings, the Booking Fee is non-refundable after the 14-day cooling-off period, even if the wedding is postponed, cancelled, or rescheduled by the Client(s).
7.19 If the Client(s) request to move the Wedding Date, the Photographer will make reasonable efforts to accommodate the new date subject to availability. If the Photographer is unavailable on the new date, the booking will be treated as a cancellation by the Client(s) and the cancellation terms in Section 12 will apply.
WHAT THIS MEANS
This section explains that your booking is only confirmed once you’ve paid my booking fee, which is taken off the total price.
You have 14 days to cancel and get a full refund, but after that the booking fee is non-refundable. The remaining balance needs to be paid before your wedding (usually 4 weeks before), unless we’ve agreed a payment plan in writing.
If payment isn’t made on time, I may cancel the booking and won’t be required to attend. Any extras must be paid for upfront, and I won’t deliver photos or products until everything is fully paid. Late payments may incur fees and interest.
If you need to move your wedding date, I’ll try to accommodate it, but it depends on my availability—otherwise it may be treated as a cancellation.
- PRICES AND ADDITIONAL EXPENSES
8.1 Prices for packages and extras paid in full before the Wedding Date are as stated at the time of signing.
8.2 Optional extras not paid in full before the Wedding Date are supplied at the prevailing price at the time of ordering.
8.3 The Client(s) is responsible for additional expenses not included in the contract price, including venue access fees, delivery to non-UK addresses, and agreed travel/accommodation costs.
8.3.1 Where applicable mileage is charged at 0.45p per mile.
8.3.2 Where applicable accommodation is charged at £125 per night.
8.3.3 Where applicable subsistence allowance is charged at £25 per day.
8.4 Travel expenses outside those specified in the Contract Summary must be paid before travel takes place.
WHAT THIS MEANS
- COMPLAINTS and DISPUTE RESOLUTION
9.1 Clients should notify the Photographer of any concerns as soon as reasonably possible.
9.1.1 This applies to both digital products and physical products.
9.1.2 Where the complaint relates to digital products no refund will be given in any circumstances should the digital products be downloaded.
9.2 Where the complaint relates to a physical product, the Client must allow up to fourteen (14) days for physical inspection and investigation.
9.2.1 The Client must pay for any physical products to be returned. It is advised to include parcel tracking.
9.2.2 Where the photographer is at fault the cost of returning the product/s will be refunded and a suitable replacement provided at no further cost to the Client.
9.2.3 Where it is deemed the product failed to misuse, abuse or fair wear and tear, a new product will be provided at cost price to the Client.
9.3 This complaints process does not affect the Client’s statutory rights.
9.4 . DISPUTE RESOLUTION
9.4.1 Clients should raise concerns directly with the Photographer.
9.4.2 Both parties agree to attempt good faith resolution.
9.4.3 Neither party shall publish knowingly false or defamatory statements.
9.4.4 Mediation may be considered before legal action.
WHAT THIS MEANS
This section explains that if you have any concerns, you need to let me know as soon as possible. If the issue is with digital products, I can’t offer a refund once they’ve been downloaded.
For physical products, I’ll need time to inspect the issue, and you’ll need to return the item at your cost (ideally with tracking).
If the problem is my fault, I’ll refund your return costs and replace it at no extra charge.
If it’s due to misuse or normal wear and tear, I can replace it at cost price. We’ll always try to resolve any issues directly and fairly between us, and may consider mediation before taking any legal action.
- FORCE MAJEURE
10.1 The Photographer shall not be liable for delay or failure to perform obligations due to circumstances beyond reasonable control, including but not limited to serious illness, injury, victim of crime, extreme weather, flooding, fire, pandemic, epidemic, government advice, guidance or legislation.
10.2 The Photographer will make reasonable efforts to attend the Wedding Date safely but may follow police/emergency service advice.
10.3 In the unlikely event that the Photographer is unable to attend due to illness, injury, or emergency, the Photographer will make reasonable efforts to arrange a qualified replacement photographer. If a replacement cannot be arranged, liability will be limited to a refund of all monies paid.
10.4 If the Photographer must cancel due to Force Majeure, liability is limited to refunding all fees paid (including Booking Fee and Balance) for services not provided.
WHAT THIS MEANS
This section explains that I’m not responsible if I can’t do my job due to things outside my control, like illness, emergencies, extreme weather, or government restrictions.
I’ll always do my best to attend safely and may follow official advice if needed. If I can’t attend, I’ll try to find a suitable replacement, but if that’s not possible, I’ll refund everything you’ve paid.
If I have to cancel due to these circumstances, my responsibility is limited to refunding any fees for services I couldn’t provide.
- DIGITAL FILE STORAGE AND LIABILITY
11.1 The Photographer will retain edited digital files for a minimum of six (6) months from the Wedding Date.
11.2 RAW files (unedited files) will normally be deleted after six (6) months unless otherwise agreed in writing.
11.3 The Client(s) are strongly advised to download and securely back up their photographs immediately upon delivery.
11.4 The Photographer cannot guarantee online gallery availability beyond twelve (12) months.
11.5 If files are lost, damaged or destroyed due to circumstances beyond reasonable control, liability is limited to the amount paid under this agreement. This does not affect statutory rights.
11.6 The Photographer takes all reasonable precautions to ensure the safe capture and storage of photographs, including the use of professional equipment and backup systems where appropriate.
11.7 In the unlikely event of equipment failure, loss of digital files, or other technical malfunction beyond the Photographer’s reasonable control, the Photographer’s liability shall be limited to the amount paid under this Agreement.
WHAT THIS MEANS
This section explains that I’ll keep your edited photos for at least six months, but unedited (RAW) files are usually deleted after that unless we agree otherwise.
You should download and back up your photos as soon as you receive them, as I can’t guarantee your online gallery will stay available beyond 12 months.
While I take every reasonable step to keep your images safe using professional equipment and backups, if files are lost or damaged due to things outside my control, my liability is limited to the amount you’ve paid.
- CANCELLATION, DATE AND PACKAGE CHANGES
12.1 Cooling-Off Rights: The Client may cancel within 14 days of paying the Booking Fee and receive a full refund (clause 7.3).
12.2 After the cooling-off period, the Booking Fee is non-refundable.
12.3 If the Client cancels after the cooling-off period, the following reasonable cancellation charges apply in addition to the Booking Fee:
(a) Less than 28 Working Days before the Wedding Date: 65% of the outstanding Balance
(b) 29 to 84 Working Days before the Wedding Date: 35% of the outstanding Balance
(c) 85+ Working Days before the Wedding Date: 0% of the outstanding Balance
12.4 Cancellation charges will be waived if the Photographer successfully re-books the same date for an equivalent package value.
12.5 Cancellation must be notified as soon as possible by telephone or email and confirmed in writing.
Office Telephone: 01633 400 051
Mobile: 07891 408 266
Email: andrew@andrew-miller.co.uk
12.6 Non-Payment Cancellation: If the booking is treated as cancelled due to non-payment under clause 7.8, this will be treated as cancellation by the Client(s) and clause 12.3 will apply.
12.7 Package upgrades/downgrades may be requested at any time and must be agreed in writing. The Client(s) must pay any price difference at prevailing rates.
WHAT THIS MEANS
This section explains that you can cancel within 14 days of booking and get a full refund, but after that the booking fee is non-refundable.
If you cancel later, you may still need to pay part of the remaining balance depending on how close it is to the wedding date. If I manage to rebook your date with another wedding of similar value, those extra cancellation charges may be waived.
You need to let me know as soon as possible if you want to cancel and confirm it in writing. If your booking is cancelled due to non-payment, it’s treated the same as if you cancelled yourself.
You can also request changes to your package at any time, but they must be agreed in writing and any price differences will be charged at current rates.
- ORDERS AND DELIVERY
13.1 Alterations to orders must be notified by email or telephone within three (3) Working Days of placing the order.
13.2 Wedding album and print production times are estimates and may vary due to bank holidays, seasonal holidays, sickness and current workload
13.3 Due to the nature of custom photographic products, refunds or exchanges are not generally available unless goods are faulty, not as described, or otherwise required under consumer law.
WHAT THIS MEANS
This section explains that if you want to make any changes to an order, you need to let me know within 3 working days.
Delivery times for albums and prints are only estimates and can vary depending on things like workload, holidays, or illness.
Because these are custom-made products, refunds or exchanges aren’t usually available unless something is faulty, incorrect, or required by law.
- PRIVACY AND DATA PROTECTION
14.1 The Photographer will store Client data securely in accordance with UK GDPR and the Data Protection Act 2018.
14.2 Data may be retained for up to seven (7) years for accounting and re-order purposes.

- INSURANCE
15.1 The Client(s) are strongly advised to take out wedding insurance to cover cancellation and related costs.
WHAT THIS MEANS
This section explains that I strongly recommend you take out wedding insurance to protect yourselves against cancellations or unexpected costs.
- MEALS AND REFRESHMENTS
16.1 The Client(s) must arrange for a meal to be provided to the Photographer during the wedding breakfast if coverage extends across this period.
16.2 If coverage extends into the evening, a second light meal should be provided.
16.3 If a meal is not provided, the Photographer may take a break off-site and cannot guarantee photography coverage during that period.
16.4 If the Photographer must purchase a meal, an invoice will be issued and must be paid before gallery access is provided.
WHAT THIS MEANS
- EXCLUSIVITY AND CONDUCT
17.1 The Photographer is the only professional photographer authorised to provide still photography services at the wedding unless agreed in writing.
17.2 Guests may take photographs for personal use provided they do not interfere with the Photographer’s work.
17.3 The Photographer is not responsible for photographs that cannot be taken or are obstructed due to interference from guests, other suppliers, or venue staff.
17.4 The Photographer strongly recommends that the Client(s) consider an “unplugged ceremony” where guests refrain from using cameras or mobile phones during key moments.
17.5 If any person behaves aggressively, threatens the Photographer, or in the opinion of the Photographer creates a serious risk of theft or damage to equipment, the Photographer may leave immediately without liability, and no refund will be due (except where required by law).
WHAT THIS MEANS
This section explains that I’m the only professional photographer booked for your wedding unless we agree otherwise. Guests are welcome to take their own photos, but they must not get in the way of my work.
I’m not responsible if shots are missed because of interference from guests, suppliers, or staff, and I recommend considering an unplugged ceremony to avoid this.
If anyone behaves aggressively or puts me or my equipment at risk, I may leave immediately, and no refund will be given.

18.2 Typical delivery estimates:

Typically, you can expect your online gallery and prints within 2–3 weeks, album drafts within 2 weeks of sending your selections, and finished albums around 8–10 weeks after you approve the design.
- WEDDING DEADLINES
19.1 The Client(s) have four (4) months from the gallery delivery date to select images for album design.
19.2 If no selections are made within four (4) months, the Photographer will assume the Client does not require the album and may refund the album value at the Photographer’s discretion.
19.3 Additional fees may apply if the Client requests album production after this deadline.
WHAT THIS MEANS
This section explains that you have four months from when your gallery is delivered to choose images for your album.
If you don’t make your selections within that time, I’ll assume you no longer want the album and may refund its value at my discretion. If you decide later that you do want an album, extra charges may apply.

WHAT THIS MEANS
This section explains that I include standard editing in my usual style, but more detailed retouching is charged hourly and may not always be possible.
I can refuse requests for heavy or unrealistic edits, and I’m not required to carry out things like AI edits, body reshaping, or major alterations unless we’ve agreed it in writing.
